These Terms of Service ("Terms") govern your use of dailywellhealth.co and any purchase you make from us. The store is operated by Dailywell ("Dailywell," "we," "us"). By using the site or placing an order, you agree to these Terms, our Privacy Policy, our Refund Policy, and our Shipping Policy.

Please read section 14 carefully. It requires most disputes to be resolved by individual binding arbitration and waives class actions.

1. Using the site

You must be at least the age of majority where you live to buy from us. You agree not to use the site for anything illegal, to interfere with its security or operation, to scrape or copy its content without permission, or to submit false information. We may refuse service, cancel orders, or close accounts that break these Terms.

2. Products are for personal use

Our products are sold for personal use only, not for resale. We may limit or cancel orders that appear to be placed by resellers or distributors.

3. Not medical advice

Content on this site is for general information only and is not medical advice. Our products are dietary supplements. They are not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the Food and Drug Administration.

Talk to your doctor before taking any supplement, especially if you are pregnant or nursing, take medication (including blood pressure medication), or have a medical condition. Don't use a supplement in place of treatment prescribed by your doctor. Individual results vary.

4. Product information and pricing

We try to keep product descriptions, images, and prices accurate, but mistakes can happen. If we find an error in the price or description of an item you ordered, we'll contact you before shipping and give you the choice to confirm at the correct price or cancel for a full refund. Prices and offers can change without notice. Launch and sale prices apply only during the dates shown on the site.

5. Orders and payment

Placing an order is an offer to buy. We accept it when we ship it. We may decline or cancel an order for reasons including suspected fraud, stock issues, or errors, and if we do, we'll refund anything you paid. Payment is due at checkout. You confirm that you're authorized to use the payment method you provide. Applicable sales tax is calculated at checkout.

6. No subscriptions

We don't sell subscriptions. Every order is a one-time purchase, and you will never be charged again unless you place a new order.

7. Shipping and delivery

Shipping costs, processing times, and delivery estimates are in our Shipping Policy. Ownership and risk of loss pass to you when the carrier delivers your order to the address you provided.

8. 60-day money-back guarantee

If you're not happy with your order, email us within 60 days of delivery and we'll refund it in full. You keep the product. Full terms, including how refunds are processed, are in our Refund Policy.

9. Reviews and submissions

If you post a review, comment, photo, or other content, you confirm that it's yours, that it's honest, and that it reflects your own experience. You give us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display it in connection with Dailywell, including in marketing. We may remove content that is unlawful, offensive, or misleading. Testimonials reflect individual experiences and are not a guarantee of results.

10. Intellectual property

Everything on this site, including the Dailywell name and logo, text, images, and design, belongs to us or our licensors and is protected by law. You may not use it without our written permission. If you believe content on the site infringes your copyright, email us with the details required by the Digital Millennium Copyright Act.

11. Third-party links and tools

The site may link to or use third-party websites and tools. We don't control them and aren't responsible for their content or practices. Your use of them is at your own risk and subject to their terms.

12. Disclaimer of warranties

Except as stated in our Refund Policy and as required by law, the site and products are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the site will be uninterrupted or error-free.

13. Limitation of liability

To the fullest extent allowed by law, Dailywell and its owners, employees, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the site or products. Our total liability for any claim related to a purchase is limited to the amount you paid for that order. Some jurisdictions don't allow these limits, so they may not apply to you.

14. Disputes and arbitration

Talk to us first. Most problems can be solved with an email. Before starting any formal claim, contact us at support@dailywellhealth.co and give us 30 days to try to resolve it.

Binding arbitration. If we can't resolve it, you and Dailywell agree that any dispute arising from these Terms, the site, or our products will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. Either party may instead bring an individual claim in small claims court if it qualifies. The Federal Arbitration Act governs this section.

No class actions. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, consolidated, or representative proceeding.

Opting out. You can opt out of this arbitration agreement by emailing us within 30 days of your first purchase with your name, order number, and a clear statement that you opt out of arbitration.

15. Governing law

The arbitration agreement in section 14 is governed by the Federal Arbitration Act. Nothing in these Terms takes away any rights you have under the consumer protection laws of the place where you live.

16. Indemnification

You agree to defend and hold harmless Dailywell and its owners and employees from any claims, losses, or costs, including reasonable legal fees, arising from your breach of these Terms or your misuse of the site.

17. Changes and termination

We may update these Terms at any time by posting the new version here. The Terms in effect when you place an order apply to that order. We may suspend or end your access to the site if you break these Terms.

18. Other terms

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies linked above, are the entire agreement between you and us about the site and your purchases. We may assign these Terms; you may not assign them without our consent.
